Its the 9th Day since I'm no longer working for others.

It's different really.

Things that I've done in preparation:-
1) Wrote Letter to BC for no objection letter
2) Wrote Letter to BC on changing of address
3) Applied for Fax No.
4) Email created earlier
5) Name cards in process
6) Various office chops done
7) All office stationary done

Things to do:-
1) Professional Insurance
2) 2015 annual subsription
3) E-filing account
4) SSM Account
5) Bank Accounts & cheque book
6) Online research subsription
7) Domain name

New Journey

It's official. My new law firm has been established.

I've gone through difficult obstacles. The premise alone was giving me a headache.

1st Agent : made promises and confirmed the price of tenancy. However, informed me that the Landlord changed her mind 3 times.

2nd Agent : deliberately failed to disclose the fact that she herself was occupying the said premise and failed to inform the Landlord the same. I got to know this the very last two days before I met the landlord. Issue of double rental aroused as there was an offer to rent made when the tenancy was still in existence! Landlord and I refused to proceed.

It's a tough journey.

August 2014

Time flies...

Just a summary of events:-

1) I resigned from my company (Lawyer). Serving 2 months notice
2) Will be working in Sentul, KL in October
3) Still lecturing until end October 
4) Taekwondo trip to Korea next week (for 6 days)
5) Taken over all admin work for Taekwondo - alot of compiling and work to do

What I've learned from my current law firm:-

TO IMPROVE AND BE BETTER

Will always remember and apply the advice from my bosses. I'm thankful for everything that I've been through. 

I thought that this year was going to be a tough year. I was wrong. This year is a VERY tough year and it's only the beginning...

I'm looking forward working in the new law firm. When I think about how to manage my time for all my other matters, I take a deep breath....

Lecturing : Continues (Business Law) - April 2014

Received Offer to continue lecturing part-time for the Business Law Subject for Diploma in Business and Foundation in Arts students.

The last sem : Oct 2013 - Feb 2014 , lectured the Corporate Law (Bachelor Business Students) and Business Law (Diploma in Business students).

This time, it will be 3 times per week.

Time moved so fast. My first time lecturing was in March Sem intake (April -July 2011). Moving into my 4th Year Lecturing.

Semesters handled to date:-

Foundation in Arts : 4 Semesters (Business Law)
Diploma in Business : 3 Semesters (Business Law)
Bachelor in Business/Accounting : 1 Semester (Corporate Law)

Hard Work pays. I just hope I have the strength to continue.

Different Things

I am still learning different procedural areas of law... Currently:-

1) Small Estate Distribution (SEDA) a) application procedure. b) in the event Order was not obtained, application to apply for Hearing at the Land Office.

2) Probate - a) properties held on trust by Trustee - to remove the condition that it is to be held on trust for some time. b) transfer of residue property to one of the beneficiary when the other does not want the property. c) to compel the distribution of liquidated assets to all the beneficiaries by citing those who refuses grant of probate. d) new application by way or Originating Summons and no longer by Petition.

3) Civil Procedure - a) Summary Judgment application and when it is applicable. b) written submission for appeal from judgement from lower courts

Long Call speech that was not read fully



Yang Arif, saya dengan rendah diri memohon keizinan Mahkamah untuk berhujah dalam Bahasa Inggeris.

My Lady/Lord, first and foremost, it gives me real honour to introduce the Petitioner, XXXXXX - me

The Petitioner was born on 23 December 1987 in Kota Bahru, Kelantan and is the eldest child in the family. In pursuit of his dreams, the Petitioner studied and obtained his Bachelor of Law (Hons) in 2009, at the University of the West of England, Bristol. He then proceeded to study the Certificate of Legal Practice at Brickfields Asia College and passed in December 2011 after working in MAA for a year. The Petitioner also studied the Diploma in International Arbitration on a part time basis when he was working in MAA.

During his studies, the Petitioner has been actively involved in teaching Taekwondo as a sport and martial art. The Petitioner is a 3rd Dan Black Belt holder in both Malaysia and Korea; and a registered National Taekwondo Instructor of Malaysia recognised by Skim Perlesenan Kejurulatihan Kebangsaan.

Besides teaching Taekwondo, the Petitioner is also passionate in officiating Taekwondo Sparring Championships and has officiated championships since 2011 as a Kyorogi Referee. The Petitioner, who has a Junior Poomsae Judge qualification, was recently appointed to sit as one of the three Poomsae Judge in a Championship.

The Petitioner read in the chambers of Messrs John Yong & Irene Song and chambered under the expert guidance of his master Mr. John Yong. The Petitioner wishes to express his utmost gratitude to his master for his undying patience  and guidance during the 9 months of pupilage. The Petitioner wishes to say “Thank You” again and the petitioner wishes to state that he will be keeping in touch with his Master.

On this special day, the petitioner would like to express his deepest gratitude to his parents, Mr David Kuan and Madam Grace Chow and his loved ones for their unconditional love and support. Without the support and encouragement of his loved ones, he would not be able to stand here proudly today to be admitted into the Malaysian Bar. The Petitioner is thankful that his grandparents, Mr George Pasqual Kuan and Madam Nancy Khoo had travelled all the way from Penang last night to share this joyous occasion with him.

He would also like to extend his appreciation to several other people:-

Firstly, he would like to thank his seniors and collegues for their guidance and valuable advice.

Secondly, he would like to thank his best friends including Mr Kenny for their support and encouragement at all times.

Thirdly, all his college and university mates, and Lecturers especially Dr Chanteney for nominating him as her best student for year 2005.

Special thanks to his MAA Bosses Mr VJ, Mr Philip and Mr Ong for their guidance, advice and most importantly, their warm friendship.

Special thanks to all those that stood by him in moments of difficulties which includes Anna Poori, Asherra, Sabrina, Nor Hafiszuan, Satheesan, Melanie and Melody. 

Special thanks to all his Church Friends at Sri Petaling Methodist Church, Life Methodist Church and Bandar Kinrara Methodist Church for their prayers.

Special thanks to his school teachers including Puan Lee.

Special thanks to all his Taekwondo students for their lovely smiles which kept him going.

And last but not least, he would like to thank his mover, Mr Low Chee Hoong for taking time to move his call.

My Lady/Lord, I believe that the papers are in order and that the Petitioner is a fit and proper person to be admitted and enrolled as an Advocate and Solicitor in the High Court of Malaya and there are no objections from the AG’s Chambers, Bar Council and Selangor Committee. Therefore I humbly pray that the petitioner, XXXXXX - me, be admitted and registered as an Advocate and Solicitor  of the High Court of Malaya.

Seniority

American Heritage Dictionary:-
  1. The state of being older than another or others or higher in rank than another or others.
  2. Precedence of position, especially precedence over others of the same rank by reason of a longer span of service.
My Dictionary:-
"ANYONE WHO IS OF HIGHER RANK OR LONGER SERVICE ( BUT THE RANK CARRIES MORE WEIGHT THAN THE LENGTH OF SERVICE)"

I am not happy today. Plain rude and disrespectful (not to me... today). This is my first time witnessing this and I hope it will be the last time. If it happened in front of me again..... I am really going to bring this up to all top management. It is an unwritten law that the respect must be given to all lawyers. It is unacceptable to be rude to any lawyers. I cannot accept it. I will not accept it. 
It is absolutely ABSURD to even think of if. I may be becoming a lawyer , but that does not mean that I can be rude to anyone I like. Respect must be given to anyone irrespective of rank,age,sex, etc. But it is CLEAR and CERTAIN that ANY lawyer must be respected in ALL circumstances because by the end of the day, they are the ones that must be responsible for ALL actions (whether by themselves or their staffs or the WEATHER or even ACT OF GOD).

As long as I am in a working environment, these shall apply:-

1) I will not tolerate rudeness irrespective of rank. 

2) I will not tolerate rudeness to anyone "deemed fit to be called a senior".

3) I will not tolerate rudeness from anyone towards an "advocate & solicitor"

Thank you, shut up and take a good look in the mirror before you be rude to someone, cause that just shows who you truly are and lastly, fk off from my face.
